These Terms are a legal agreement between you and KIS Consultancy BV (“we”, “us”) governing your use of Fantastic Chess (the “Game”). By downloading or playing, you agree to them. If you don’t agree, don’t use the Game.
1 Eligibility
You must be at least 13 (or the minimum age in your country) to play. If you’re a minor, you may only play with a parent’s or guardian’s permission.
2 License
We grant you a personal, non-exclusive, non-transferable, revocable license to install and play the Game for personal, non-commercial entertainment. You may not copy, modify, reverse-engineer, resell, or exploit the Game except as allowed by law.
3 Accounts
You’re responsible for activity under your account and for keeping access secure. Don’t impersonate others or choose usernames that are offensive, infringing, or misleading.
4 Virtual items and currency
The Game includes virtual currency (Coins, Gems) and virtual items (cards, packs). These have no real-world monetary value, cannot be exchanged for real money, and are licensed, not sold or owned by you. We may manage, modify, or remove virtual items and currency, and may adjust game balance, at our discretion. Virtual items and currency are non-refundable except where required by law or by the applicable app store’s policies.
5 Purchases
Any real-money purchases are processed by Apple or Google and are subject to their terms. Your statutory refund rights and the app store’s refund policies apply.
6 Randomized packs
Some card packs contain randomized contents. Where such packs are available for purchase with real money, the probabilities of receiving items are disclosed at fantasticchess.com/pack-odds and/or within the Game.
7 Fair play and conduct
Don’t cheat, use bots or unauthorized third-party software, exploit bugs, manipulate matchmaking or ratings, harass other players, or disrupt the service. We may suspend or terminate accounts that violate these Terms.
8 Our content
The Game, including its art, characters, names, and software, is owned by us or our licensors and protected by intellectual-property laws.
9 Termination
We may suspend or terminate your access if you breach these Terms or to protect the service. You may stop playing and delete your account at any time.
10 Disclaimers
The Game is provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law.
11 Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability relating to the Game is limited to the greater of the amount you paid us in the past 12 months or USD $50.
12 Governing law
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-laws rules. Any disputes arising from or relating to these Terms or the Game will be subject to the exclusive jurisdiction of the competent courts of the Netherlands, except where mandatory consumer-protection law provides otherwise.
13 Changes
We may update these Terms; continued play after changes means you accept them.
14 Apple App Store — additional terms
If you obtained the Game from the Apple App Store, you acknowledge: these Terms are between you and us only, not Apple; Apple has no obligation to provide support or maintenance for the Game; Apple is not responsible for any product warranties or claims (including product-liability, legal-compliance, or intellectual-property claims); and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a U.S.-embargoed country or on a U.S. prohibited-parties list.
